Therapeutic Use Exemptions (TUEs) in sports medicine

Abstract

The role of sports medicine doctors extends beyond injury management to include the regulation of doping in sports, particularly through the knowledge of World Anti-Doping Agency (WADA) documents and the process of obtaining Therapeutic Use Exemptions (TUEs). This chapter examines the importance of TUEs, which permit athletes with legitimate medical conditions to use prohibited substances or methods for therapeutic purposes. Despite concerns about fairness and integrity, studies indicate that the prevalence of TUEs among athletes remains low, with no significant correlation between TUEs and performance enhancement. The chapter outlines the TUE application process, including the role of National Anti-Doping Organizations (NADOs) and Therapeutic Use Exemption Committees (TUECs), and emphasizes the necessity of comprehensive medical documentation. It discusses the criteria for granting TUEs, the implications of the “Strict Liability Principle,” and the conditions under which retroactive TUEs may be granted. Finally, the chapter underscores the ethical responsibilities of sports physicians in navigating the complexities of TUE applications, promoting an environment of fairness and health in competitive sports.
